DESIGNABLE TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of Vizreal AI’s websites, applications, artificial intelligence tools, project-generation services, hosting features, deployment tools, subscriptions, credits, and related products and services collectively referred to as the “Service.”

The Service is operated by [Full Legal Company Name], doing business as Vizreal AI (“Vizreal AI,” “we,” “us,” or “our”).

By creating an account, submitting a prompt for generation, purchasing a subscription, or otherwise using the Service, you agree to these Terms and our Privacy Policy and AI Acceptable Use Policy.

Do not use the Service unless you understand and agree to these Terms.

1. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account or enter into a paid subscription.

A person who has not reached the age of legal majority may use the Service only through an account created and supervised by a parent or legal guardian who accepts these Terms and assumes responsibility for that use.

The Service is not directed to children under 13. Children under 13 may not create accounts or submit personal information through the Service.

When using Vizreal AI for an organization, company, or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Description of the Service

Vizreal AI provides AI-assisted tools that may allow users to:

  • Generate websites, applications, interfaces, content, code, images, videos, database structures, and other materials.
  • Modify projects through conversational instructions.
  • Preview generated projects.
  • Connect third-party services.
  • Store project files and project history.
  • Export generated code where available.
  • Publish or deploy projects using Cloudflare or other supported infrastructure.
  • Connect custom domains.
  • Collaborate with team members.
  • Purchase credits and subscription plans.

Features may change, be added, be limited, or be discontinued as the Service evolves.

Vizreal AI does not guarantee that every requested feature, integration, application, website, or deployment can be generated successfully.

3. Accounts

Some public pages may be viewed without creating an account.

You may enter a project prompt before registering. However, you must create an account or sign in before Vizreal AI begins generating, saving, or deploying a project.

You agree to provide accurate information and keep your account information current.

You are responsible for:

  • Protecting your password and authentication credentials.
  • All activity occurring through your account.
  • Restricting unauthorized access to your account.
  • Promptly notifying Vizreal AI of suspected unauthorized access.
  • Ensuring that team members and collaborators comply with these Terms.

You may not share login credentials outside your authorized organization or allow another person to impersonate you.

We may require email verification, identity verification, multi-factor authentication, or other security measures.

4. AI-Generated Results

Vizreal AI uses artificial intelligence and automated development systems to interpret prompts and generate project materials.

AI-generated results may:

  • Contain errors.
  • Contain incomplete or insecure code.
  • Produce unexpected results.
  • Misunderstand instructions.
  • Contain inaccurate information.
  • Resemble material created for other users.
  • Require human review, testing, correction, or professional advice.

You are responsible for reviewing and testing all generated materials before publishing, distributing, selling, or relying on them.

You must independently verify:

  • Code functionality.
  • Application security.
  • Legal compliance.
  • Accessibility.
  • Payment flows.
  • Database behavior.
  • Privacy disclosures.
  • Intellectual-property rights.
  • Health, financial, legal, employment, or safety-related content.
  • Third-party integrations.
  • App-store requirements.
  • Domain and hosting configuration.

Vizreal AI does not guarantee that generated content is accurate, unique, non-infringing, secure, lawful, or fit for a particular purpose.

5. User Instructions and Project Content

“User Content” includes prompts, instructions, text, code, images, documents, files, brands, logos, business information, data, and other materials you submit to the Service.

You retain ownership of your User Content.

You grant Vizreal AI a worldwide, non-exclusive, limited license to host, copy, process, transmit, modify, display, and use User Content only as reasonably necessary to:

  • Provide and maintain the Service.
  • Generate and modify your projects.
  • Display previews.
  • Process deployments.
  • Provide support.
  • Detect fraud, abuse, security threats, and policy violations.
  • Comply with legal obligations.

You represent that you have all rights and permissions necessary to submit and use your User Content.

You may not upload or use material that violates another person’s copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights.

6. Ownership of Generated Projects

As between you and Vizreal AI, and subject to applicable law, third-party rights, open-source licenses, and these Terms, you may use the project output generated specifically for you through your account.

Your rights do not extend to:

  • Vizreal AI’s platform software.
  • Vizreal AI’s proprietary agent system.
  • Vizreal AI branding or trademarks.
  • Internal system prompts.
  • Security mechanisms.
  • Platform templates identified as proprietary.
  • Third-party software, models, fonts, images, libraries, APIs, or assets.
  • Materials belonging to other users.

AI-generated output may not qualify for copyright protection in every jurisdiction. Vizreal AI does not promise that you will obtain exclusive rights to any generated output.

Similar or identical output may be generated for other users.

7. Open-Source and Third-Party Components

Generated projects may use open-source software, frameworks, packages, fonts, icons, APIs, or other third-party components.

Those materials remain subject to their respective licenses and terms.

You are responsible for reviewing and complying with:

  • Open-source license requirements.
  • Attribution requirements.
  • Commercial-use restrictions.
  • API provider terms.
  • App-store rules.
  • Payment provider terms.
  • Cloud hosting terms.
  • Third-party data-processing requirements.

Vizreal AI may restrict or remove a third-party integration when necessary for security, legal compliance, platform stability, or provider requirements.

8. Credits

Vizreal AI may use a credit-based system for AI generation and related actions.

New eligible users may receive 10 promotional credits after completing required account verification. Free credits:

  • Have no cash value.
  • Are not transferable.
  • Are not refundable.
  • May not be sold.
  • May expire if disclosed at the time they are issued.
  • May be withheld or removed when fraud or abuse is suspected.
  • Are limited to one legitimate new-user allocation per person or organization unless otherwise stated.

Actions may consume different numbers of credits depending on complexity, computing resources, model usage, file size, generation length, or other factors.

The estimated credit cost may differ from the final cost when the scope of an operation changes.

We will attempt to display applicable credit costs before beginning a chargeable operation.

Credits may be deducted when an operation begins, as milestones are completed, or when an operation completes.

When a chargeable operation fails because of a confirmed Vizreal AI system error before meaningful work is delivered, Vizreal AI may automatically restore affected credits. Credits are not necessarily restored when failure results from:

  • Invalid user instructions.
  • Unsupported requests.
  • Third-party outages.
  • User-provided code.
  • User-provided credentials.
  • External API limitations.
  • Policy violations.
  • Account restrictions.
  • User cancellation after resources have been consumed.

We may adjust credit costs prospectively. Changes will not reduce credits already purchased unless required to address fraud, chargebacks, or errors.

9. Subscriptions and Plans

Vizreal AI may offer plans including:

  • A $25 monthly plan.
  • A $50 monthly plan.
  • A $100 monthly plan.
  • Other plans or promotional offers.

The exact plan names, included credits, storage, project limits, deployment limits, collaboration features, and other allowances will be displayed before purchase.

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.

You authorize Vizreal AI and its payment processor to charge the applicable subscription price, taxes, and approved fees to your selected payment method.

Plan prices and features may change. When required, we will provide notice before a change affects your next renewal.

Unused monthly credits may expire at the end of the billing period unless the applicable plan expressly permits rollover.

Promotional pricing may end at the conclusion of the stated promotional period.

10. Payments

Payments may be processed by Stripe or another authorized payment provider.

Vizreal AI does not directly store complete payment-card numbers.

You agree to provide current and accurate billing information.

You remain responsible for:

  • Subscription charges.
  • Usage charges.
  • Applicable taxes.
  • Chargebacks caused by authorized use of your account.
  • Fees clearly disclosed before purchase.

A failed payment may result in:

  • Suspension of generation features.
  • Suspension of deployments.
  • Downgrade to a free plan.
  • Loss of access to paid features.
  • Cancellation of the subscription.

We may retry failed charges as permitted by law and payment-provider rules.

11. Cancellations and Refunds

You may cancel a subscription through your billing settings or the available billing portal.

Cancellation generally takes effect at the end of the current paid billing period unless otherwise stated.

Except where required by law:

  • Subscription payments are non-refundable.
  • Partially used billing periods are not prorated.
  • Used credits are non-refundable.
  • Promotional credits are non-refundable.
  • Domain-registration fees and third-party charges are non-refundable.
  • Completed AI operations are non-refundable.

Vizreal AI may issue refunds or account credits at its discretion. A discretionary refund does not create an obligation to provide similar refunds in the future.

12. Deployments and Hosting

Vizreal AI may provide deployment services through Cloudflare or other providers.

Deployment availability depends on:

  • Valid account status.
  • Available plan limits.
  • Valid third-party credentials.
  • Successful project builds.
  • Compliance with these Terms.
  • Availability of hosting providers.
  • Domain and DNS configuration.
  • Applicable technical limitations.

We do not guarantee uninterrupted hosting, deployment, domain availability, search-engine ranking, traffic, sales, app-store approval, or compatibility with every device.

You are responsible for reviewing a project before publishing it.

You are also responsible for the legality and operation of deployed projects, including:

  • Privacy notices.
  • Cookie consent.
  • Terms presented to your users.
  • Accessibility requirements.
  • Data collection.
  • Product claims.
  • Payment obligations.
  • Taxes.
  • Security.
  • Moderation.
  • Customer support.
  • Regulatory compliance.

We may suspend or remove a deployment that creates a security risk, violates law, violates these Terms, infringes rights, or may harm Vizreal AI, its providers, users, or the public.

13. Custom Domains

You must own or have authority to use any domain connected to Vizreal AI.

You are responsible for:

  • Domain-registration fees.
  • Renewal fees.
  • Registrar settings.
  • DNS configuration.
  • Trademark disputes.
  • Domain expiration.
  • Domain security.
  • Accurate registration information.

Vizreal AI is not responsible for losing a domain because of expiration, registrar action, transfer error, inaccurate information, or unauthorized access outside Vizreal AI’s systems.

14. Exporting Projects

Where supported, you may export generated project files or connect a project to a supported source-control provider.

Exports may not include:

  • Vizreal AI’s proprietary systems.
  • Internal prompts.
  • Hosted agent services.
  • Platform-only components.
  • Third-party licensed assets that cannot legally be transferred.
  • Managed credentials or encrypted secrets.
  • Features requiring an active Vizreal AI subscription.

You are responsible for configuring, maintaining, securing, and supporting an exported project after it leaves Vizreal AI.

15. Prohibited Conduct

You may not:

  • Violate the AI Acceptable Use Policy.
  • Access another user’s account or project without authorization.
  • Circumvent credit limits, payment controls, usage limits, or security measures.
  • Create fraudulent accounts to obtain additional free credits.
  • Reverse engineer or extract Vizreal AI’s proprietary agent instructions.
  • Scrape the Service without written permission.
  • Introduce malware, spyware, ransomware, destructive code, or harmful scripts.
  • Interfere with the Service or impose unreasonable infrastructure loads.
  • Use automated methods to create accounts or abuse promotions.
  • Misrepresent generated content as professionally reviewed when it has not been reviewed.
  • Use Vizreal AI to infringe intellectual-property rights.
  • Use Vizreal AI to impersonate another person or organization deceptively.
  • Resell access to the Service without authorization.
  • Use the Service in violation of sanctions, export controls, or applicable law.

16. Intellectual-Property Complaints

Vizreal AI respects intellectual-property rights.

A rights holder may submit a complaint containing:

  • Identification of the protected work.
  • Identification of the allegedly infringing material.
  • The project or deployment URL.
  • The complainant’s contact information.
  • A good-faith statement that the use is unauthorized.
  • A statement that the submitted information is accurate.
  • A physical or electronic signature.

We may remove or restrict material and terminate repeat infringers where appropriate.

17. Feedback

You may provide suggestions, ideas, or feedback about Vizreal AI.

You grant Vizreal AI permission to use that feedback without restriction or compensation, provided we do not publicly identify you without permission.

18. Confidentiality and Secrets

Do not place sensitive credentials directly into prompts, public project files, frontend code, chat messages, or unencrypted uploads.

Use Vizreal AI’s designated secret-management tools when available.

You are responsible for rotating any credential that is accidentally exposed.

Vizreal AI may scan project files for exposed secrets and warn, block, redact, or remove credentials when detected.

19. Privacy

Our collection and use of personal information are described in the Vizreal AI Privacy Policy.

You acknowledge that project instructions may be processed by service providers required to operate the Service, including AI, hosting, security, analytics, communications, and payment providers.

Do not submit personal information that you are not authorized to process.

When you build a project that collects information from your own users, you are responsible for establishing a lawful basis, providing required notices, obtaining required consent, and honoring user rights.

20. Suspension and Termination

You may stop using the Service at any time.

We may restrict, suspend, or terminate access when:

  • You violate these Terms.
  • Payment is overdue.
  • Fraud or abuse is suspected.
  • Your activity presents a security risk.
  • Your activity may expose Vizreal AI to legal liability.
  • We are required to act by law or a service provider.
  • Continued service is technically impractical.

When reasonably possible, we may provide notice and an opportunity to correct the issue.

Immediate action may be taken in urgent security, fraud, abuse, or legal situations.

After termination, access to projects and deployments may end. You should export important project information before closing your account.

We may retain information when required for security, fraud prevention, billing, dispute resolution, legal compliance, or enforcement.

21. Service Availability

The Service is provided on an “as available” basis.

Vizreal AI may experience:

  • Maintenance.
  • Model outages.
  • Cloud-provider outages.
  • Delayed generations.
  • Failed builds.
  • Third-party API interruptions.
  • Deployment failures.
  • Data synchronization delays.
  • Feature changes.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

22. Beta Features

Some features may be labeled beta, preview, experimental, early access, or similar.

These features may be incomplete, unstable, changed, or removed without notice.

You use beta features at your own risk and should not rely on them for critical production systems without independent safeguards.

23. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL GENERATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

DESIGNABLE DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, AND RESULTS.

DESIGNABLE DOES NOT WARRANT THAT:

  • GENERATED CODE WILL BE ERROR-FREE OR SECURE.
  • A PROJECT WILL MEET EVERY REQUIREMENT.
  • GENERATED OUTPUT WILL BE UNIQUE.
  • DEPLOYMENTS WILL REMAIN ONLINE WITHOUT INTERRUPTION.
  • APPLICATIONS WILL BE APPROVED BY AN APP STORE.
  • A WEBSITE WILL ACHIEVE A PARTICULAR SEARCH RANKING.
  • A PROJECT WILL GENERATE REVENUE OR BUSINESS RESULTS.
  • GENERATED INFORMATION IS PROFESSIONAL LEGAL, MEDICAL, FINANCIAL, OR OTHER ADVICE.

Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.

24. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIGNABLE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR OPPORTUNITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIGNABLE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID DESIGNABLE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR 2. ONE HUNDRED U.S. DOLLARS.

These limitations apply regardless of the legal theory and even when Vizreal AI has been advised of the possibility of damages.

Some jurisdictions do not permit certain liability limitations, so portions of this section may not apply to you.

25. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Vizreal AI and its owners, officers, employees, contractors, affiliates, and providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:

  • Your User Content.
  • Your generated or deployed projects.
  • Your violation of these Terms.
  • Your violation of law.
  • Your infringement of another person’s rights.
  • Products or services offered through your project.
  • Data collected through your project.
  • Actions taken by users of your project.

26. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable federal law, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes that are not subject to a separate arbitration agreement will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.

27. Changes to These Terms

We may update these Terms to reflect changes in the Service, law, security requirements, or business practices.

The updated version will show a revised “Last Updated” date.

When changes are material, we may provide additional notice through email, an account notification, or the Service.

Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.

28. Electronic Communications

You agree to receive electronic communications relating to:

  • Your account.
  • Security.
  • Billing.
  • Projects.
  • Deployments.
  • Policy updates.
  • Service changes.

Transactional communications are part of the Service and may continue even when you opt out of marketing communications.

29. General Provisions

These Terms, the Privacy Policy, the AI Acceptable Use Policy, and any applicable plan-specific terms constitute the agreement between you and Vizreal AI regarding the Service.

If one provision is unenforceable, the remaining provisions remain effective.

Vizreal AI’s failure to enforce a provision is not a waiver.

You may not transfer your rights under these Terms without our consent. Vizreal AI may transfer its rights as part of a merger, acquisition, financing, reorganization, or sale of assets.

Headings are provided for convenience and do not affect interpretation.
